1. Introduction
This document governs the general terms and conditions of use of the ch.rentals portal (hereinafter referred to as the ‘Portal’), managed by Bramo Sagl, with registered office in Lugano, Switzerland.
Use of the Portal implies full acceptance of these Terms and Conditions by users (hereinafter referred to as ‘User’ or ‘Users’), whether they are Hosts (landlords) or Guests (tenants).
If the User does not intend to accept these Terms in full, they are invited not to use the Portal.

2. Purpose of the service
The ch.rentals Portal offers a digital platform that connects Hosts and Guests for the publication, search, booking and management of short-term tourist rentals and rentals located exclusively in Switzerland.
Bramo Sagl acts solely as a technical and commercial intermediary between the parties, without being a contractual party to the rental or hire agreement concluded between the Host and the Guest.

3. Registration and account
To access the Portal’s services, the User must create a personal account, providing truthful, complete and up-to-date information.
The User is responsible for the confidentiality of their login credentials and the use of their account.
Bramo Sagl reserves the right to suspend or close accounts that violate these Terms or that use the Portal in an improper or fraudulent manner.

4. Publication of advertisements
Hosts may publish advertisements relating to properties or units intended for short-term tourist rentals.
Advertisements must contain truthful, accurate information that complies with Swiss regulations on tourist rentals, safety, hygiene and local authorisations.
Bramo Sagl reserves the right to modify, suspend or remove content that is false, misleading, unlawful or inappropriate.

5. Bookings and contracts between Users
Bookings made through the Portal constitute a direct contract between the Host and the Guest.

Bramo Sagl is not a party to this contract and assumes no responsibility for the quality, availability or compliance of the accommodation or service offered.
Any disputes, cancellations or refund requests must be handled directly between the parties, in accordance with the conditions agreed upon at the time of booking.

6. Payments and fees
The Portal may provide for:

service fees applied to Hosts, Guests or both, calculated as a percentage or as a fixed amount;

premium subscriptions or additional paid services for Hosts (e.g. increased visibility, listing management, professional support);

any transaction costs associated with electronic payment methods.

Rates and payment methods are indicated on the Portal and may be updated by Bramo Sagl at any time.
Payments are handled by third-party payment service providers (PSPs) in accordance with Swiss law.

7. Cancellations and refunds
Cancellation and refund conditions are determined by Hosts and communicated within each listing.
The Portal recommends clarity and transparency in cancellation policies to avoid disputes between the parties.
Bramo Sagl is not responsible for the non-execution, cancellation or modification of bookings.

8. User responsibility
Users undertake to:

use the Portal in a lawful manner and in accordance with Swiss law;

not publish false, misleading or offensive content;

comply with applicable tax, municipal and tourism regulations;

behave appropriately towards other Users and Bramo Sagl staff.

The Host is fully responsible for the property offered, its safety, cleanliness, suitability and compliance with applicable laws and regulations.

9. Limitation of liability
Bramo Sagl does not guarantee that the Portal will be free from errors, interruptions or malfunctions and accepts no liability for:

direct or indirect damage resulting from the use or inability to use the Portal;

disputes between Hosts and Guests;

loss of data, loss of earnings or consequential damage.

Under no circumstances shall Bramo Sagl’s total liability exceed the amount of commissions actually received for the transaction that is the subject of the dispute.

10. Intellectual property
All contents of the Portal (trademarks, texts, images, layout, software, logos) are the exclusive property of Bramo Sagl or their respective rights holders.
Any unauthorised reproduction, distribution or use of the content is prohibited.

11. Changes to the Terms
Bramo Sagl reserves the right to change these Terms and Conditions at any time.
The changes will take effect from the moment they are published on the Portal.
Continued use of the Portal after publication constitutes implicit acceptance of the changes.

12. Applicable law and jurisdiction
These Terms and Conditions are governed by Swiss law.
Any dispute arising from the use of the Portal or the interpretation of these Terms shall be subject to the exclusive jurisdiction of the Court of Lugano (Switzerland).
